3. Delivery
4. Cancellation / Withdrawal
5. Ownership
The vehicle will belong to us until the total purchase price has been paid in full. Any cheque will not be treated as payment until it has been cleared so time will have to be allowed for this.
6. New Vehicle
If the vehicle ordered is a new one, the following will apply:
7. Vehicle Inspection and Handover
Prior to taking delivery of the Vehicle, the Customer shall inspect the Vehicle carefully to satisfy themselves as to its visible condition and shall notify the supplying dealership of any visible damage, cosmetic defects, missing items, or discrepancies before signing the Vehicle Handover Documentation. Any such matters identified at the time of inspection shall be recorded on the Vehicle Handover Documentation. Failure to report any visible damage, cosmetic defects, missing items or discrepancies prior to vehicle handover may result in the Customer being held responsible for any such items on return.
By signing the Vehicle Handover Documentation, the Customer confirms that they have been given a reasonable opportunity to inspect the Vehicle, that any visible damage, cosmetic defects, missing items or discrepancies identified during that inspection have been recorded on the Vehicle Handover Documentation, and that they acknowledge the Vehicle's visible condition at the time of handover as recorded on the Vehicle Handover Documentation.
The supplying dealership shall not be responsible for rectifying or accepting claims in respect of any visible damage, cosmetic defect, missing item, or discrepancy that could have been identified during the Customer's inspection prior to the Vehicle Handover Documentation being signed, but which was not recorded on the Vehicle Handover Documentation.
Nothing in this clause limits or excludes the Customer's statutory rights.
